DIGEST OF INTRODUCED BILL
Emergency 911 tort immunity. Provides that a governmental entity or employee is liable for a loss resulting from the development, adoption, implementation, operation, maintenance, or use of an enhanced emergency communication system unless the loss results from a failure or delay in the dispatch of emergency assistance because of: (1) malfunction of communications or emergency response equipment that could not reasonably have been prevented; or (2) all emergency response equipment and personnel available to the governmental entity have been dispatched to other emergencies. Requires a governmental entity to request assistance from all persons with whom the governmental entity has an emergency assistance agreement before the immunity applies.
