IURC enforcement authority. Gives the Indiana utility regulatory commission (IURC) authority to impose a civil penalty of not more than $2,000 if a public utility (1) has failed to meet the same standard of service established by the IURC by rule in effect on January 1, 2001, or (2) has willfully failed to comply with a rate or service requirement of a final and unappealable order of the commission. Requires the IURC to consider certain factors when imposing civil penalties. Provides that commercial radio service, rural electric membership corporations, and rural telephone cooperatives are exempt from IURC authority to impose civil penalties. Requires the attorney general to bring an action in a court of jurisdiction to enforce a civil penalty. Defines "merchant power plant". Provides that merchant power plants are subject to the jurisdiction of the commission. Requires the IURC to notify an agency that has zoning authority over the site of the proposed merchant power plant of a petition for approval of the merchant power plant. Gives the local zoning authority 30 days to provide the IURC with land use planning information regarding the site and other issues that local officials consider relevant to consideration of the petition. Requires the IURC to consider the information provided by the local zoning authority when making a decision regarding the petition.
