DIGEST OF INTRODUCED BILL


Attorney's fees in civil actions. Requires an award of reasonable and necessary attorney's fees to the prevailing party in a civil action when the nonprevailing party: (1) brought the action on a claim or asserted a defense that is frivolous, unreasonable, vexatious, or groundless; (2) continued to litigate the action or defense after the party's claim or defense clearly became frivolous, unreasonable, vexatious, or groundless; or (3) litigated the action in bad faith. Exempts governmental entities and employees from liability for an award of attorney's fees.
