Township flood control and drainage works. Provides that the legislative body of a township, with the concurrence of the executive of the township, may adopt and file with the legislative body of the county in which the township is located a resolution providing for the establishment of a township flood control district or a township drainage district. Provides that a township flood control district or township drainage district is established: (1) when the county legislative body adopts an ordinance establishing the district; or (2) if the county legislative body takes no action on the township resolution after 120 days, when
Township flood control and drainage works. Provides that the legislative body of a township, with the concurrence of the executive of the township, may adopt and file with the legislative body of the county in which the township is located a resolution providing for the establishment of a township flood control district or a township drainage district. Provides that a township flood control district or township drainage district is established: (1) when the county legislative body adopts an ordinance establishing the district; or (2) if the county legislative body takes no action on the township resolution after 120 days, when
the township legislative body adopts a second resolution establishing the township flood control district or township drainage district. Provides that the construction of the township flood control works or drainage works is under the control of a township flood control board or township drainage board, which consists of the members of the township legislative body. Authorizes a township flood control board or drainage board to enter into a contract with another political subdivision under which some or all of the work of constructing the flood control works or drainage works will be performed by the other political subdivision. Provides that a township flood control district or township drainage district may contain a single special assessment district or multiple special assessment districts. Makes each taxable parcel in a special assessment district subject to a special benefit assessment to provide money to pay the cost of constructing and maintaining the flood control works or drainage works. Provides that if a flood control or drainage district contains multiple special assessment districts, the rate of the special benefit assessment imposed in each special assessment district must correspond to the benefit derived by the property owners of the special assessment district from the construction of the flood control works or drainage works. Provides that if: (1) the city or county in which a township is located has adopted an ordinance establishing a multi-year capital improvement plan providing for the construction of one or more flood control or drainage projects; (2) the flood control or drainage project provided for in the multi-year capital improvement plan would address the same problems for which flood control or drainage works are constructed by the township flood control or drainage district; and (3) the legislative body of the township filed the resolution proposing the establishment of the township flood control or drainage district with the legislative body of the county before the time set by the multi-year capital improvement plan for the construction of the flood control or drainage project; the city or county shall, at the time set by the multi-year capital improvement plan for the construction of the flood control or drainage project, disburse to the township flood control board or drainage board approximately the same funds that would have been expended under the multi-year capital improvement plan for the construction of the flood control or drainage project.
