Specialized driving privileges. Allows a court to stay a person's driving privileges suspension by not submitting the probable cause affidavit related to the person's offense to the bureau of motor vehicles (bureau) if the person indicates to the court, at the initial hearing, that the person intends to file a petition for a specialized driving privileges hearing. Provides that if the person does not file a petition for a specialized driving privileges hearing after seven days from the date of the initial hearing with the court, the court shall lift the stay of the person's suspension of driving privileges and
Specialized driving privileges. Allows a court to stay a person's driving privileges suspension by not submitting the probable cause affidavit related to the person's offense to the bureau of motor vehicles (bureau) if the person indicates to the court, at the initial hearing, that the person intends to file a petition for a specialized driving privileges hearing. Provides that if the person does not file a petition for a specialized driving privileges hearing after seven days from the date of the initial hearing with the court, the court shall lift the stay of the person's suspension of driving privileges and
shall submit the probable cause affidavit related to the person's offense to the bureau for automatic suspension. If a person files a petition for a specialized driving privileges hearing within the seven days, the stay of the driving privileges suspension continues until the matter is heard and a determination is made by the court at the specialized driving privileges hearing. Provides that the court must set a specialized driving privileges hearing, if requested, not later than 30 days after the initial hearing. Sets parameters for a person's driving privileges suspension due to delays caused by the court, the prosecuting attorney, and the person. Adds that a judge must inform a person that the person may request a specialized driving privileges hearing during an initial hearing when the person is charged with certain driving related offenses. Requires an individual with suspended driving privileges who seeks specialized driving privileges to file a petition for specialized driving privileges in the court that ordered or imposed the suspension.
